A one-year-old child was killed Sunday morning in Queens after being struck by a pickup truck driven by a man with an active driving while intoxicated (DWI) case, authorities said.
The incident occurred at approximately 8:30 a.m. on 32nd Avenue in the Murray Hill neighborhood. According to the Queens District Attorney’s Office, Elvin Rivera, 57, was driving a white Chevrolet Silverado when he ran a stop sign and hit Justin Hu, who was being pushed in a stroller by his nanny. Emergency medical services transported both victims to a nearby hospital, where the child was pronounced dead shortly after arrival. The nanny sustained an injury to her right arm.
Prosecutors reported that Rivera, who remained at the scene, tested positive for traces of cocaine and THC and failed a field sobriety test. They noted that Rivera also faces an open DWI case from a separate incident in The Bronx in April.
Queens District Attorney Melinda Katz described the death as a "heartbreaking" and "completely avoidable" tragedy. Rivera has pleaded not guilty to multiple charges related to the crash and was ordered held without bail by Judge Michael Katz.
