The Court of First Instance in Kuwait has ordered the Director General of Kuwait Municipality to issue property description certificates for several real estate assets, a decision that addresses a recent dispute involving property owners and municipal authorities. The ruling came after the Municipality had declined to provide the certificates without a clear legal basis, obstructing property owners from partitioning their assets and delineating their individual shares.

Attorney Abdullah Mansour Al-Furaih, representing the plaintiffs in the case, argued that the Municipality’s refusal lacked justification. During court proceedings, he presented evidence supporting the plaintiffs’ position and requested the court to compel the Municipality to issue the necessary documentation.

The court ruled in favor of the plaintiffs, mandating the Municipality to release the property certificates. This decision is expected to facilitate the partitioning of the involved properties and the segregation of ownership shares, a critical step in moving forward with preparations for a public auction of the assets.

The Municipality’s previous stance had effectively hindered the property owners from advancing their interests in managing and selling their real estate holdings. With the court order in place, the involved parties now have the official documentation required to proceed, marking a significant development in the resolution of property disputes within Kuwait’s legal framework.
