Seven NHS nurses at County Durham and Darlington NHS Foundation Trust have been awarded £187,000 in damages following a legal dispute over the use of female changing facilities by a transgender colleague. The group, known as the Darlington Seven, challenged the trust after Rose Henderson, a biological male identifying as a woman, was permitted to use the female changing room.
The case was heard by Employment Judge Seamus Sweeney, who ruled that allowing Henderson access to the female facilities resulted in a workplace environment that was “hostile, intimidating, humiliating and degrading” for the nurses. The judge found that the trust had failed to address the nurses’ concerns adequately, concluding that the trust’s actions amounted to harassment.
The Darlington Seven brought the case on the grounds that their rights to a safe and private working environment were compromised. The ruling emphasized the trust’s responsibility to balance the rights of transgender employees with those of other staff members, a balance that, in this instance, was not maintained.
The decision highlights ongoing challenges within public institutions around accommodating transgender rights while respecting the privacy and comfort of all employees. The trust had allowed Henderson to use the female changing area without consulting or appropriately addressing the unease expressed by other staff members.
While the judgment recognized the rights of transgender individuals to access facilities in line with their gender identity, it also underscored that this should not come at the expense of creating a hostile working environment for others. The case has drawn attention to the need for clearer policies and better communication regarding workplace accommodations related to gender identity.
The trust is expected to review its policies following the ruling to prevent similar disputes from arising in the future. The damages awarded to the Darlington Seven reflect the seriousness with which the tribunal viewed the breach of their rights in the workplace.
