Federal authorities have charged two men in connection with the fatal fentanyl overdoses of two college students in Manhattan, New York. The superseding indictment, unsealed Thursday, alleges that the men distributed fentanyl-laced drugs to the victims, resulting in the death of one woman and the overdose of another. Additionally, one of the victims was sexually assaulted after losing consciousness.

According to prosecutors, 19-year-old Moises Freire and 18-year-old Brian Peralta Cabrera supplied the women with substances they were told were pure cocaine, but which contained fentanyl. The overdoses occurred on March 18 at a college dormitory in Manhattan, though officials have not disclosed the name of the institution. Both women lost consciousness shortly after ingesting the drugs. During this time, federal prosecutors allege that Freire raped one of the victims while she was incapacitated.

Freire reportedly waited approximately 45 minutes before notifying campus security. In the interim, he took photographs of the unconscious women and shared them with others. One woman survived following medical intervention, while the other died four days later from acute fentanyl intoxication. Toxicology reports confirmed fentanyl presence in both victims, with no traces of cocaine detected.

Freire was taken into custody on the day of the incident, and Peralta Cabrera was arrested six days later. The two men face charges including conspiracy to distribute a controlled substance resulting in death, which carries a mandatory minimum sentence of 20 years in prison up to life imprisonment. Freire faces additional charges of distribution resulting in death and serious bodily injury, and distribution with intent to facilitate sexual assault.

Freire, who resides in the Bronx, has remained in custody since his arrest, following a denied bail application. Peralta Cabrera, from Queens, was released on a $75,000 bond and is under home detention with electronic monitoring. U.S. Attorney Jamie McDonald described the case as involving both the deadly distribution of fentanyl and the sexual assault of a victim who was rendered defenseless by the drugs. Authorities continue to investigate the circumstances surrounding the incident.
