Emily Moreno, daughter of Senator Bernie Moreno (R-Ohio), has filed a new restraining order against her ex-husband, Representative Max Miller (R-Ohio), citing allegations of domestic violence and recent confrontations. The request, submitted Thursday, details an incident during a court hearing on Tuesday, in which Moreno claims Miller physically grabbed one of her attorneys, Andrew Zashin, and directed profane language toward Zashin’s fiancée as they exited the courtroom.
According to Moreno’s filing, Miller provoked Zashin by challenging him to confront him, stating phrases like “Come at me!” Moreno contends that unless restrained, Miller will continue to harass and communicate directly with her counsel.
Attempts to reach Miller’s representatives for comment were unsuccessful, while Zashin declined to respond to inquiries. Miller and Moreno, who share a daughter born in November 2023, have been embroiled in a contentious custody dispute involving mutual allegations of abuse. The couple married in August 2022 and divorced in June 2025. Miller, 37, is currently seeking a third term representing Ohio’s 7th Congressional District.
Moreno’s previous court filings include serious accusations against Miller, such as an incident in June 2024 when she says Miller threw hot water at her from a pan and subsequently sprayed her with a sink hose. She also alleges physical abuse against their 2-year-old daughter, referencing a police report from February that documented a fractured collarbone with a bruise consistent with a handprint. The report also recounts Moreno’s claim that Miller once pointed a gun at her head and acted abusively in front of their child.
Miller has denied all allegations of abuse against both Moreno and their daughter, attributing the claims to Moreno’s alleged mental instability. Last month, he described the accusations as false during an interview with Spectrum News. Moreno’s legal team has denied assertions regarding her mental health. Miller himself had accused Moreno of domestic violence, but a judge recently dismissed his case, determining that he did not appear to be in fear or threatened by her.
Additionally, Miller criticized Senator Bernie Moreno on the social media platform X, accusing him of enabling what Miller describes as a “malicious campaign” by his daughter against Miller, despite being aware of her mental health challenges.

In a statement released by his spokesperson, Reagan McCarthy, the senator emphasized that his “top priority is the safety and well-being of his daughter and granddaughter.” McCarthy added that while the senator does not engage in public disputes over these matters, he is committed to pursuing a just resolution for his family.
