Fortescue Metals Group has terminated the contract of a senior executive following an independent investigation into allegations of sexual harassment and psychological abuse, the company confirmed on Wednesday. The probe, conducted by law firm Minter Ellison over several months, substantiated multiple complaints made by a female employee.
The investigation, which began after the employee reported the misconduct, found the executive had breached Fortescue’s policies and corporate values. The allegations reportedly covered a period of at least five years and included claims that the executive entered the complainant’s home without permission and destroyed photographs of her partner. Additional complaints from other employees were also examined, though details on findings relating to those were not disclosed.
Sources said that numerous witnesses were interviewed during the inquiry, which broadened significantly beyond its original scope initiated in late August. The executive, who had been working remotely on paid leave during the investigation, submitted a resignation before the final report was delivered. However, a subcommittee of Fortescue’s board decided to terminate the contract immediately for cause.
A Fortescue spokesperson stated, “The investigation found conduct that breached Fortescue’s policies, as well as our values. The board subcommittee overseeing the matter therefore ceased the individual’s contract.” The company emphasized that sexual harassment and bullying are not tolerated within its workforce.
Prior to being stood down on full pay in late August, the executive had been allowed to continue working, albeit from a home office, a decision Fortescue said was based on legal counsel. As the investigation progressed, the board adhered closely to external legal and governance advice in managing the matter.
The termination occurs amid a separate class action lawsuit filed on behalf of current and former female employees, alleging the company failed to protect them from sex discrimination, sexual harassment, and a hostile work environment.
Fortescue’s senior leadership team was briefed on the investigation’s outcome on Wednesday, marking a significant development in the company’s handling of workplace conduct issues. The company has not released the executive’s identity, citing legal restrictions.
