Radio broadcaster Jackie “O” Henderson has expanded her ongoing Federal Court lawsuit against former employer ARN, introducing an additional claim alleging a breach of a $3 million loan agreement related to the purchase of company shares. Henderson continues to pursue legal action against ARN and its subsidiary, the Commonwealth Broadcasting Corporation (CBC), following the termination of her 10-year contract worth approximately $100 million.

The dispute arose after a highly publicised on-air confrontation between Henderson and co-host Kyle Sandilands, which culminated in the dissolution of their long-standing contracts. While Sandilands reached a settlement with ARN, Henderson maintained her claim, asserting that her dismissal constituted adverse action after she expressed an inability to continue working with Sandilands on the KIIS FM breakfast program.

In her statement of claim, Henderson seeks compensation exceeding $82 million. The amended lawsuit filed on Tuesday includes an allegation that ARN breached an agreement to provide CBC with a limited recourse loan of $3 million to facilitate the purchase of ordinary shares in ARN on her behalf. According to the amended claim, it was an explicit term of the agreement that CBC would extend this loan to Henderson Media, Henderson’s company.

Henderson’s legal team contends that ARN was authorised to sell the shares only under certain conditions, such as a breach of the agreement by Henderson or its termination under agreed circumstances. However, on April 29, ARN’s board declared that a "bad leaver" event had occurred, prompting the sale of Henderson’s shares to repay the outstanding loan.

ARN has denied wrongdoing and is defending the lawsuit. Court documents submitted by the broadcaster acknowledge the off-air tension following the broadcasters’ on-air argument, confirming that “Ms Henderson and Mr Sandilands had a heated argument off air.”

The case remains ongoing as Henderson seeks resolution over the compensation and the alleged contractual breaches.
