Judge Nicholas Rowland has faced criticism for issuing lenient sentences in several serious cases, including handing a community order to a repeat sex offender found with extreme pornography and suspended sentences for convicted thieves. Political figures have called for his dismissal, arguing that harsher penalties are necessary to appropriately punish and deter grave offenses.

Judge Nicholas Rowland, who recently faced criticism for his sentencing decisions in a high-profile Hampshire rape case involving teenage travellers, has come under scrutiny for a pattern of lenient judgments in other serious cases.

Among the rulings attracting attention, Judge Rowland handed a community order to Daniel Rushton, a convicted sex offender, after he was found in possession of extreme pornography. Rushton, who in 2023 received a suspended sentence for attempting to engage in sexual communication with a child online, was subsequently arrested again when monitoring software installed on his phone as part of a sexual harm prevention order detected images depicting bestiality. Despite these circumstances, Judge Rowland imposed a 12-month community order for that offence last month.

In a separate case, Judge Rowland sentenced Kornel Marcinek, a 25-year-old driver, to 21 months in prison after causing the death of Joe Burton, a 33-year-old electrician from Southampton. Marcinek was driving his BMW at 37 mph in a 30 mph zone while under the influence of marijuana when he collided with Burton from behind. Burton had been married for three months at the time of the accident. Marcinek admitted to causing death by dangerous driving, driving without due care and attention, and driving without insurance.

Additionally, in 2024, Judge Rowland imposed suspended sentences on two individuals convicted of stealing £76,000 worth of jewellery from a cruise ship.

These sentencing decisions have sparked criticism from political figures. Shadow Home Secretary Chris Philp called for Judge Rowland’s dismissal, stating that the judge’s decision to spare the repeat offenders involved in the rape case from custody was "appalling." Philp emphasized the seriousness of the crimes, noting that the perpetrators had filmed themselves during the assaults, and argued that prison sentences were necessary to serve both as punishment and deterrence.

It remains unclear whether any of these sentences have been referred to the Attorney General for review.

The controversy highlights ongoing debates around judicial discretion and sentencing guidelines, with some advocating for stricter penalties in cases involving sexual offences and dangerous driving, while officials recognize the complexity of balancing rehabilitation and punishment in the justice system.
