KUWAIT CITY — The Kuwait Center for Commercial Arbitration (KCCA), affiliated with the Kuwait Chamber of Commerce and Industry, held a seminar on June 22 focused on the judicial oversight of arbitration awards and its role in preserving justice and arbitration effectiveness. The event gathered legal professionals including consultants, judges, lawyers, and arbitration experts to discuss current practices in the commercial and investment arbitration sector.

Dr. Khaled Mohammad Al-Amira, a legal consultant, led the seminar by outlining the three essential pillars underpinning the arbitration system: the arbitration agreement forming the basis for dispute resolution, the conduct of arbitration proceedings before an arbitration panel, and the issuance of arbitration awards grounded in factual and legal justifications. He emphasized that judicial review of domestic arbitration awards is not intended to undermine arbitration but rather to safeguard the arbitration framework through rigorous technical and legal standards.

The seminar explored two main mechanisms of judicial oversight over arbitration awards in Kuwait. The first mechanism involves filing an original action to nullify a domestic arbitration award before the Court of First Instance within 30 days of the award issuance. This procedure requires a deposit of KD50 and permits a comprehensive review including verification of arbitration conditions and potential grounds for annulment as stipulated in Article 187 of the Kuwaiti Code of Civil Procedure. These grounds include substantive issues such as the invalidity of the arbitration agreement, as well as procedural violations like breaches of the right to a defense and serious concerns such as fraud or forgery.

The second mechanism pertains to judicial control exercised through an appeal against the enforcement order of a domestic arbitration award. Enforcement applications are submitted to the judge of urgent matters, typically the president of the Court of First Instance, who oversees the procedural aspects of giving effect to arbitration awards within the judicial system.

The secretary general of the Kuwait Center for Commercial Arbitration underscored that the seminar aligns with the center’s ongoing efforts to enhance the institutional arbitration environment in Kuwait. He highlighted the importance of fostering a stable and mutually supportive relationship between the judiciary and arbitration bodies. According to him, clearly delineating the scope of judicial oversight is fundamental to building a transparent, secure, and appealing investment climate for both local and international investors.
