The federal government and Queensland Premier David Crisafulli remain at odds over the energy framework governing data centre approvals following a recent National Cabinet meeting. The dispute highlights ongoing tensions between state and federal authorities over energy policy amid a surge in demand driven by artificial intelligence and data storage needs.

Queensland, which controls a substantial portion of its electricity transmission, distribution, and generation infrastructure, sought to establish its own conditions for approving data centres. Crisafulli proposed mandatory local consultation processes, regulations on water usage, and opposed requirements mandating power from wind and solar sources. Both Queensland and the Northern Territory— which anticipates leveraging gas from the Beetaloo Basin project to power upcoming data hubs—claimed success after the National Cabinet discussions, describing a so-called “Queensland exemption” that would allow data centres to use gas or coal energy.

However, federal Resources Minister Madeleine King and Climate Minister Chris Bowen have asserted that no such exemption exists. Bowen emphasized that national binding standards would require data centres across Australia to source 100% of their energy from renewables supported by firming technologies, which may include gas. Any deviation from this framework would be subject to review and approval by the Australian Energy Regulator, making it clear that fossil fuel usage cannot proceed without explicit federal consent. Bowen’s firm position indicates potential constitutional conflict with Queensland, a state known for challenging federal mandates.

The disagreement reflects broader debates over energy policy in an era where data centres are critical to supporting artificial intelligence applications. Australia’s competitors in the AI sector, including the United States and China, are pursuing aggressive, albeit diverse, energy strategies—embracing gas-fired capacity, nuclear power, coal, and renewables—to fuel data infrastructure without as strict carbon constraints. The U.S. alone plans 189 gigawatts of gas-fired power linked directly to data centres, while Chinese electricity for data storage remains heavily coal-dependent despite rapid renewable expansion.

National party leader Matt Canavan warned that stringent net-zero policies could undermine Australia’s ability to retain and attract industrial investment, drawing parallels between the energy challenges faced by aluminium smelters and data centres. He called into question the feasibility of net-zero targets if the energy demands of key industries are not adequately addressed.

Australia, with abundant reserves of coal, gas, uranium, wind, and solar resources, faces a complex balancing act between achieving climate goals and maintaining energy-intensive sectors crucial to economic growth and technological advancement.
