Two individuals have been charged with murder following a fatal fentanyl overdose in Prosper earlier this year, authorities announced Wednesday.

On January 31, officers from the Prosper Police Department responded to a 911 call reporting a possible overdose at a residence on the 100 block of West Sixth Street. Upon arrival, they found an adult male resident deceased inside the home. Subsequent investigation determined the cause of death to be a lethal dose of fentanyl.

Jessica Shirey, 30, of Wylie, was identified as the person who supplied the fentanyl to the victim. She was arrested on May 27 and booked into the Collin County jail on a murder charge. Further inquiry revealed that Shirey had obtained the fentanyl from Joey Jimenez, 32, of Dallas. On June 11, Prosper detectives, with assistance from Dallas police, executed arrest and search warrants at Jimenez’s Dallas residence. Jimenez was taken into custody without incident and also charged with murder.

“This tragic loss underscores the deadly nature of fentanyl,” said Prosper interim Police Chief Ken Myers. “Even a small amount can be fatal, and our thoughts remain with the victim’s family and loved ones during this difficult time.”

The charges are based on Texas House Bill 6, which became effective in 2023. The law allows prosecutors to charge individuals with murder if they knowingly manufacture or deliver fentanyl that causes another person’s death, regardless of intent to kill. Prosecutors recently secured the first successful conviction under this statute in Dallas County, resulting in a 20-year prison sentence.
