A Texas couple has reached an agreement with Florida prosecutors that allows them to avoid jail time in a child neglect case involving their 6-month-old infant. Sara Sommers Wilks, 37, a regional president at US Heart and Vascular in Houston, and her husband, Brian David Wilks, 40, entered into deferred prosecution agreements last month in Walton County, Florida.
The case arose after allegations that the couple left their infant unattended on a beach while they went for a walk. Under the terms of the agreement, the Wilkses must each pay $1,000 in fines and court costs, complete 25 hours of community service, attend a parenting class, and refrain from any further legal violations during the one-year probationary period. Additionally, they must remain barred from Walton County and have waived their right to a speedy trial.
Deferred prosecution agreements typically allow defendants to avoid formal criminal charges if they meet specified conditions, a resolution that both spares the court system and provides an opportunity for offenders to demonstrate compliance and rehabilitation.
The agreement concludes the case without further court proceedings, provided the couple fulfills all the stipulated requirements. No further details about the circumstances of the incident or the couple’s response to the allegations have been released.
