Flock Safety, the company behind widely deployed license plate reader (LPR) cameras, has recently faced significant criticism amid concerns over privacy, potential misuse, and insufficient oversight of its surveillance technology. These cameras, often solar-powered and mounted on poles, capture license plates and upload the data to centralized databases, enabling law enforcement to track vehicles’ movements across multiple locations. While proponents highlight the technology’s utility in solving crimes such as kidnappings, opponents warn that it contributes to an expanding surveillance network eroding civil liberties.

Over the past weeks, more than 25 municipalities in Massachusetts, including Boston, Wellesley, Salem, Framingham, and most recently Barnstable, have ended their contracts with Flock Safety. Critics point to multiple incidents underpinning public unease, including an allegation that a New Bedford police officer used Flock to monitor a former partner, and reports that a Texas officer searched thousands of Flock cameras in an abortion-related investigation. The company recently launched new software called Freeform, which incorporates video analytics capable of tracking individuals’ movements, clothing, and vehicle features, raising further privacy concerns.

The controversies have spotlighted gaps in the oversight and regulation of LPR technology. Until recently, law enforcement officials could initiate searches in the Flock system based solely on their discretion, with minimal external review. In response to public pressure, the company has introduced changes such as limiting data retention to seven days, requiring an active criminal case to conduct searches—except in emergencies—and allowing police departments to disable information sharing with other agencies, including federal authorities. Some departments have independently implemented additional controls; for example, the Lynn Police Department now mandates supervisor approval before permitting searches, and audit mechanisms monitor for repetitive or suspicious queries.

Despite these measures, experts argue that a key safeguard remains absent: the requirement that law enforcement obtain a warrant before accessing LPR data. Rooted in constitutional principles dating back to the Fourth Amendment, a warrant process involves judicial review to ensure probable cause justifies each search. Courts in Massachusetts have so far deemed warrants unnecessary for LPR use, but the state’s Supreme Judicial Court has acknowledged that the increasing ubiquity of these devices could change the legal landscape, noting potential privacy infringements arising from comprehensive tracking of individuals’ public movements.

Advocates for stricter regulation maintain that while LPRs can be valuable investigative tools, their deployment must be balanced against privacy rights through clear legal frameworks. They contend that only by instituting a warrant requirement can abuse be effectively curbed and public trust restored. Until such protections are legally mandated, many communities are likely to maintain their bans on Flock cameras. Law enforcement officials, while recognizing the technology’s benefits, have so far expressed mixed views on calls for tighter judicial oversight.

The debate over Flock Safety’s technology reflects broader tensions around surveillance, public safety, and individual privacy in the digital age. As LPR networks continue to expand, policymakers in Massachusetts and beyond face increasing pressure to establish consistent, transparent guardrails governing their use.
