Vigilante efforts to disable Flock Safety’s automated license plate reader cameras are spreading across at least three dozen states, driven by growing public concern over privacy and the unchecked expansion of surveillance technology. Critics argue that the broad deployment of these systems, often implemented without explicit public or legislative approval, raises significant civil liberties and data protection issues.
Flock Safety, a leading provider in this market, estimates that approximately 5,000 law enforcement agencies nationwide utilize its cameras. These devices capture photographs of every passing vehicle, convert license plate information into machine-readable data, and store geotagged images. This allows law enforcement to search for specific plates or identify all vehicles present at a given location and time. However, the extensive collection of data includes images of all drivers, not just those under investigation, creating a mass surveillance environment.
Concerns about potential misuse have intensified following several high-profile incidents. A 2020 California State Auditor report found that 99.9% of the 320 million images collected by the Los Angeles Police Department captured vehicles unrelated to any criminal inquiry. In addition, earlier controversies have included New York police surveilling mosque congregants after the September 11 attacks, federal agencies planning to monitor gun shows, and a Texas sheriff’s office using the system to track a woman who had an abortion. Data sharing with Immigration and Customs Enforcement (ICE) in California, in apparent violation of state law, and repeated unauthorized searches by individual officers further highlight the risk of abuse.
Despite these concerns, the Los Angeles Police Department ceased its contract with Flock Safety last July due to privacy issues. Other agencies, however, continue to rely on plate reader data with minimal oversight. Audits of such systems frequently reveal a lack of formal policies or effective monitoring mechanisms to prevent unauthorized or excessive use.
Although various local governments have approved installation of license plate reader technologies, there has been little comprehensive legislative debate or federal regulation on their use or the management of the vast data they generate. States have adopted inconsistent standards: Utah mandates deletion of most license plate data after nine months, New Hampshire requires deletion within minutes, and California is considering a policy that would require warrants for searches of data older than 75 days, without enforcing automatic deletion.
Meanwhile, privacy advocates note that voluntary changes by Flock Safety, such as reducing default data storage from 30 days to seven, do not address the fundamental issues, as these defaults vary and are not legally binding. Civil liberties experts have emphasized the need for clear laws that establish retention limits and restrict data access to protect location privacy and prevent indiscriminate surveillance.
Bipartisan legislative proposals have recently emerged in Congress, introduced by Republican Representatives Tim Burchett and Thomas Massie, signaling some political momentum toward regulating license plate reader technology. However, until binding federal standards are enacted, vigilantism disabling surveillance cameras may persist.
Experts argue that without formal oversight and democratic authorization, the current widespread use of these systems runs counter to principles of privacy and autonomy. The debate continues over how to balance public safety benefits against the risks of creating a de facto nationwide surveillance network in the absence of meaningful legal safeguards.
