The Administrative Circuit of Kuwait’s Court of First Instance has overturned a decision by the Technical Committee of the Public Authority for Disabled Affairs regarding the disability status of a Kuwaiti woman. The court ruled that the woman qualifies under the provisions of the Law on the Rights of Persons with Disabilities, ordering the issuance of a certificate that recognizes her as having a permanent, moderate visual impairment.

The legal dispute arose after the Technical Committee initially rejected the woman’s classification as visually impaired, which affected her eligibility for benefits provided by the law. The court found that the committee’s decision conflicted with medical assessments confirming the extent of her visual impairment. As a result, the court annulled the committee’s ruling and affirmed her entitlement to receive the official certificate and access all benefits to which she is legally entitled.

Mohammed Sati Al-Otaibi, the woman’s lawyer, stated that the initial rejection by the Technical Committee was inconsistent with the medical evidence presented. He noted that the court’s decision effectively secured justice for his client by formally recognizing her visual impairment and ensuring her rights under Kuwaiti disability law.

This ruling highlights ongoing challenges faced by individuals with disabilities in Kuwait in securing official recognition and access to related services and benefits. The court’s intervention reinforces the legal framework designed to protect the rights of persons with disabilities in the country.
